July 16, 1811:
Elijah Massey, out of love and affection for Pamela Lambden Massey
(daughter of Benjamin Massey) and Francis Massey (daughter of James
Massey) gives the 229 acre tract called Angels Rest
(Elijah's present home) to Pamela and Francis as tenants in common with
the proviso that, should Pamela die unmarried before the age of 21, her
share of Angels Rest should go to Carolyn Massey (another daughter of
Benjamin Massey). Angels Rest was acquired by Elijah from Thomas Witherspoon and adjoins lands of Casparis Meginniss
and Benjamin Massey. Witnesses: Charles Harding and William
Farrell, Junior. Ben Chambers recorded the deed as Kent County

County aforesaid: Be it remembered that on the fifteenth day of July
eighteen hundred and eleven the following deed was brought to be
recorded among the records
of Kent County of the tenor and in the words following to wit: This
indenture made the sixteenth day of April in the year of our Lord one
thousand eight hundred and eleven
between Elijah Massey of Kent County and state of Maryland of the one
part and Pamela Lambden Massey, daughter of Benjamin Massey, and Francis
Massey, daughter of James Massey of the other part. Witnesseth
that the said Elijah Massey as well for the love and affection which he
the said Elijah Massey hath [illegible] unto the said Pamela L. Massey
and James Massey as also for the better maintenance, support,
livelihood,
and [illegible] of them, the said Pamela L. Massey and Francis Massey,
hath given, granted, aliened, enfeoffed, confirmed, and by these
presents
doth give, grant, alien, enfoff, and confirm unto
the said Pamela L. Massey and Francis Massey as tenants in common
with this reservation. exception, and condition, that should the said
Pamela L. Massey die before she arrives to the age of 21 years and
without getting married, I do then and in that case entail the reversion
of his moiety or half part to Carolyn Massey daughter of said Benjamin
Massey, her heirs, and assigns, forever all that tract or parcel of land
he
the said Elijah Massey now lives on, called and known by the name of
Angels Rest, which lands he the said Elijah Massey bought of Thomas
Witherspoon and adjoining the lands which he the aforesaid Elijah Massey
conveyed to his grandson Winder Massey and the lands of Casparis
Meginniss and Benjamin Massey, containing by estimation 229 acres be the
same more or less together with all and singular the houses, buildings,
advantages, emoluments, heriditaments, and appurtenances whatsoever to
the
said tract or parcel of land and premises hereby mentioned or intended
to be granted and confirmed unto the said Pamela Massey and Francis
Massey as aforesaid any part or parcel thereof belonging and anywise
appertaining or where with all commonly held used occupied or enjoyed or
accepted [illegible] or known as part or parcel of or belonging to the
same and the reversion and reversions, remainder and remainders, rents,
assurances, and profits of all
and singular the said premises with their appurtenances and all the
estate, right, title, interest, property, claim, and demand whatsoever
him the
said Elijah Massey of in and to the said tract or parcel of land and
premises and of and in and to any part and parcel thereof with this and
every of their [illegible] appurtenances to have and to hold the said
tract of land and all and singular other the premises hereby granted and
confirmed or mentioned or intended to be with every of their
appurtenances with the said Pamela Lambden Massey and Francis Massey as
tenants in common, share and share alike, their and each of every of
their
heirs and assigns forever as tenants in common to the only purpose use
and behoof of them the said Pamela Lambden Massey and Francis Massey,
their heirs, and assigns, forever as tenants in common with the
exception
and condition herein before made and [illegible] and the said Elijah
Massey for himself, his heirs, executors, and administrators, doth grant
and
agree to and with the said Pamela Lambden Massey and Francis Massey,
their heirs, and assigns, by these presents that they, the said Pamela
L.
Massey and Francis Massey, and in case of the death of the said Pamela
L.
Massey has before mentioned and described to and with Carolyn Massey
their and any of their heirs and assigns shall and lawfully may from
this from time to time and at all times hereafter reasonably and quietly
have, hold ,and [illegible] possess, and enjoy the said tract or parcel
of
land and premises hereby granted and conveyed or intended to be hereby
granted, conveyed, and confirmed with the appurtenances thereunto
belonging [illegible] and fully discharged or well and sufficiently
saved kept [illegible] and indemnified of from and against all former or
other gifts, grants, bargain, sales, jointures, feoffments, dowers,
estates,
entails, rents, rent charges, assuages of rents, judgments,
executions,and of from and against all former other title troubles,
charges, and
encumbrances whatsoever had done or suffered by him the said Elijah
Massey, his heirs, or assigns, or any other person or persons lawfully
claiming or to claim by, from, or under him them or any of them. In
witness whereof the parties to these presents have hereunto set their
hands and affixed their seals the day and year above written. Elijah Massey {seal }
The words, "his heirs and assigns forever," between the third and fourth line from the bottom in the first page and the words, "and the lands of," between the fourth and fifth lines from the top in the second page all interlined before executed. Teste: Charles Harding William Farrell, Junior On the back of the same deed was the following endorsement written: Maryland to wit: On the 16th day of April in the year of our Lord 1811 personally appeared Elijah Massey of Kent County, party grantor mentioned in the within deed or instrument of writing before us, the subscribers, two of the Justices of the Peace of said state for Kent County and acknowledged the said or within deed as the instrument of writing to be his act and deed and the lands and premises therein mentioned and thereby bargained and conveyed to be the right and estate of Pamela L. Massey and Francis Massey, party grantees, also therein mentioned, their heirs, and assigns, forever according to the true intent and meaning of the said deed or instrument of writing and the acts of assembly in such case made [illegible] acknowledged and certified by ... Charles Harding and William Farrell, Junior
And the same deed was accordingly executed the 16th day of July 1811 by Ben Chambers, clerk. |
