Winder Massey to Benjamin Massey, February 3, 1813

February 3, 1813: Winder Massey of the city of Philadelphia transfers ownership of the 142 acre tract called Angels Rest back to Benjamin Massey, having received timely repayment of the £710 debt plus legal interest owed by Benjamin to Winder.  Winder previously had been given the land by his grandfather (on March 19, 1811) and subsequently sold it to Benjamin. Witnesses: Kent County Justices of the Peace Jervis Spencer and Samuel Boyer; Ben Chambers is Kent County clerk.

State of Maryland Kent County: Be it remembered, that on the third day of February in the year of our Lord eighteen hundred and thirteen, the following release of mortgage was brought to be enrolled among the records of Kent County of the tenor and in the words following to wit: This indenture made this twenty-ninth day of January in the year of our Lord eighteen hundred and thirteen by and between Winder Massey of the city of Philadelphia of the one part and Benjamin Massey of Kent County and State of Maryland of the other part. Witnesseth that whereas the said Benjamin Massey did by his mortgage deed bearing date the twenty-eighth day of June in the year of our Lord eighteen hundred and eleven, duly executed and recorded amongst the records of Kent County, make over and convey to said Winder Massey, his heirs and assigns forever, all and singular that tract or part of a tract of land and premises situate lying and being Kent County aforesaid called Angels Rest, and being the same lands which the said Winder Massey purchased of or obtained by deed of gift from his grandfather, and being the same premises sold and conveyed by the said Winder Massey to the said Benjamin Massey by him the said Winder Massey, the deed of bargain and sale bearing date the date of the mortgage deed above alluded to and contained within the following metes and bounds: Beginning at the original beginning of the aforesaid Angels Rest, where now there is planted a large stone, and running from thence West four hundred and twenty perches to a parcel of stones at the end of the first line of said tract of land, thence South fifty four perches and a half, thence East four hundred and twenty perches to intersect the home line of the original tract of lot of said land, thence North fifty four perches and a half to the beginning and containing and laid out for one hundred and forty two acres of land more or less, together with all the houses, buildings, woods, timber, improvements, and appurtenances thereto belonging, which said land and premises were conveyed by the said Benjamin Massey to said Winder Massey as above stated as and for security for the payment of the sum of seven hundred and ten pounds current money at certain times in a certain terms and conditions therein stated, and whereas the said Winder Massey does by these presents acknowledge to have received from the said Benjamin Massey the said sum of seven hundred and ten pounds with the interest thereon, and that the said Benjamin Massey hath fully complied with the several covenants and agreements contained in said deed or instrument of writing. Now therefore the said Winder Massey hath and by these presents doth hereby release and reconvey to the said Benjamin Massey, his heirs, and assigns, forever all and singular the lands premises and appurtenances hereby before mentioned and described declaring the same to be the right and estate of him, the said Benjamin Massey, his heirs, and assigns, forever and further, the said Winder Massey does covenant and agree to and with the said Benjamin Massey, that he had not made any other assignment or conveyance of the said mortgage deed or said mortgaged premises, and that the said described premises he will against every person claiming or to claim by under or through him the said Winder Massey well and truly forever warrant and defend. In witness whereof the parties to these presents have hereunto set their hands and affixed their seals the day and year above written.

Kent County state of Maryland to wit: Be it remembered that, on the twenty-ninth day of January in the year of our Lord eighteen hundred and thirteen, personally appeared Winder Massey, party grantor in the written deed or instrument of writing before us, two of the Justices of the Peace of the State of Maryland in and for Kent County and did acknowledge the written and foregoing instrument of writing to be his act and deed and the lands and premises therein granted bargained and sold or intended to be granted bargained or released to be the right and estate of him the said Benjamin Massey, party grantee, his heirs, and assigns, forever according to the true intent and meaning of the same and the acts of assembly in such cases made and provided.
