Benjamin Massey from Jonathan Vanhorn and wife Elizabeth, December 2, 1812

January 18, 1813: Benjamin Massey of Kent County and State of Maryland buys for $826.87 the 142 acre tract called Goose Haven (said tract inherited by Elizabeth (nee Comegys) Vanhorn from the William Comegys, Senior and her own father William, and adjoing the land of Arthur Wheatley) from Jonathan Vanhorn and wife Elizabeth Vanhorn.  Witnesses: John Thomas and William Farrell, Junior; Ben Chambers is Kent County Clerk.

State of Maryland Kent County to wit: Be it remembered that, on the eighteenth day of January in the year of our Lord eighteen hundred and thirteen, the following deed was brought to be enrolled among the records of Kent County of the tenor and in the words following to wit: This indenture made the second day of December in the year of our Lord eighteen hundred and twelve between Jonathan Vanhorn and Elizabeth Vanhorn, his wife, of Bucks County and the Commonwealth of Pennsylvania of the one part, and Benjamin Massey of Kent County and the State of Maryland of the other part. Witnesseth that the said Jonathan Vanhorn and Elizabeth Vanhorn, his wife, for and in consideration of the sum of eight hundred and twenty six dollars, eighty seven cents current money of the United States, to the said Jonathan Vanhorn in hand paid by the said Benjamin Massey before the sealing and delivery of these presents, the receipt whereof the said Jonathan Vanhorn and Elizabeth Vanhorn do hereby acknowledge and from every part and parcel thereof do hereby acquit, exonerate, and discharge the said Benjamin Massey, his heirs, executors, and administrators, they, the said Jonathan Vanhorn and Elizabeth Vanhorn, have granted, bargained, sold, aliened, enfeoffed, and confirmed and by these presents do grant, bargain, sell, alien, enfeoff, and confirm unto the said Benjamin Massey, his heirs, and assigns, all that part or parcel of a tract of land situate lying and being in Kent County aforesaid called Goose Haven, contained within the following bounds and distances: that is to say, beginning at a white oak in the woods and running from thence North eighty one degrees West two hundred and eighty two perches to a stone on the west side of the Mill Branch, then South nine degrees and three quarters of the degree East one hundred and four perches and one half of a perch to a stone, thence South eighty seven degrees and one half degree East by and with the lands of Arthur Wheatley two hundred and fifty four perches, then with a straight line to the beginning, containing one hundred and forty two acres of land more or less, which said part or parcel of a tract of land descended to the said Elizabeth, the daughter and heir of a certain William Comegys, from the senior William Comegys, his father, together with all and singular the woods, ways, waters, watercourses, buildings, improvements, rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversion and reversions, rents, issues, and profits thereof and all the estate, right, title, and interest whatsoever of them, said Jonathan Vanhorn and Elizabeth Vanhorn, of in and to and  out of the said part or parcel of a tract of land and premises hereby granted, bargained, and sold, or meant, mentioned or intended hereby so to be in every part and parcel thereof. To have and to hold the said part or parcel of a tract of land as aforesaid described called Goose Haven or by whatsoever names the same may be called together with the buildings, appurtenances, and all and singular other the premises hereby bargained and sold or meant mentioned or intended hereby so to be and every part and parcel thereof with these and every of their appurtenances unto the said Benjamin Massey, his heirs, and assigns, forever and to and for no other use, intent, or purpose whatsoever and the said Jonathan Vanhorn and Elizabeth Vanhorn for themselves and each of them, their, and each of their heirs, executors, or administrators do and each of them doth hereby covenant, grant, promise, and agree to and with the said Benjamin Massey, his heirs, executors, or administrators, or assigns, that they, the said Jonathan Vanhorn, Elizabeth Vanhorn, and each of them and each of their heirs the part or parcel of a tract of land and premises hereby granted, bargained, and sold in every part and parcel thereof with the appurtenances thereunto belonging to him, the said Benjamin Massey, his heirs, and assigns, against them, the said Jonathan Vanhorn and Elizabeth Vanhorn, and each of them, their, and each and every of their heirs and against all and every other person persons whatsoever claiming or to claim any estate, right, title, or interest in and to the said same or any part thereof shall and will hereafter warrant and forever defend by these presents. In witness whereof the parties of these presents have hereunto set their hands and affixed their seals the day and year first above written.

Kent County aforesaid: Received on the day of the date of the within deed of and from the within named Benjamin Massey the sum of eight hundred and twenty six dollars, eighty seven cents current money of the United States, being the consideration mentioned in the said deed.

Be it remembered that on the second day of December in the year eighteen hundred and twelve personally appeared Jonathan Vanhorn and Elizabeth Vanhorn his wife of Bucks County in the Commonwealth of Pennsylvania the party grantors within named before us, the subscribers, two of the Justices of the Peace for Kent County and the state of Maryland, and acknowledged the within deed or instrument of writing to be their act and deed and the lands and premises therein mentioned and thereby bargained and sold to be the right and estate of the within named Benjamin Massey, party grantee also therein mentioned, his heirs, and assigns, forever according to the purport, true intent, and meaning of the said deed or instrument of writing and acts of assembly in such cases made and provided; and the said Elizabeth Vanhorn, being by us privately examined apart from and out of the hearing of her husband whether she doth make her acknowledgment of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure, acknowledged that she doth make her acknowledgment of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure.
