[illegible]. This indenture made this 12th day of May in the year of our
Lord 1735 between Daniel Massey of Kent County and province aforesaid,
carpenter, and Mary his wife of the one part and Thomas Massey of the
said County and province, planter of the other part. Witnesseth that the
aforesaid Daniel Massey and Mary his wife for and in consideration of
the sum of 30 pounds current money to them in hand paid the receipt
whereof he the said Daniel Massey and Mary his wife does acknowledge and
thereof every part and parcel themselves to be fully satisfied
contented and paid [illegible] every part and parcel thereof the
following clearly and absolutely acquit and discharge the said Thomas
Massey his heirs and assigns forever by these presents [several words
obliterated by the recording clerk] and has given granted bargained sold
aliened enfeoffed transferred and confirmed and by these presents does
fully clearly absolutely give grand bargain sell alien enfeoff transfer
and confirm unto the said Thomas Massey his heirs and assigns forever
all part and parcel of the land called Partnership situated and being
upon the north side of Chester in the county aforesaid and beginning at a
small Spanish oak marked with nine notches standing near the head of
[illegible] and proceeding out of a branch called Pudding branch running
North 248 perches thence South 31° West 108 perches thence South 22°
West 42 perches thence South 14° West 124 perches thence with a straight
line to the first tree containing and laid out for 100 acres more or
less together with all woods underwoods trees timber [illegible] meadows
watercourses and all and singular other the right profit benefits and
privileges in all and singular other the appurtenances to the same
belonging or in anyways appertaining. To have and to hold the said part
of a tract of land with the appurtenances thereto belonging unto the
said Thomas Massey his heirs and assigns forevermore and the aforesaid
Daniel Massey and Mary his wife and their heirs do covenant grant and
agree to and with the said Thomas Massey his heirs and assigns that the
said Daniel Massey and Mary his wife at the sealing and delivery thereof
hath good rightful power and lawful authority to sell and convey the
same and that the above bargain premises in every part and parcel
thereof are free and clear from all former gifts grants bargain sales
leases joiners dowries or title of dower rents arrearages [illegible]
fines forfeitures arrears [illegible] had made or committed or done or
suffered to be done by the aforesaid Daniel Massey and Mary his wife or
by any other persons whatsoever by their [illegible] or powers absent
[illegible] services from henceforth and growing due and payable to the
chief Lord or Lords of the fees only accepted and [illegible] and the
said Daniel Massey and Mary his wife doth by these presents forever
quitclaim and release all the right title and interest property claim or
demand that the aforesaid Daniel Massey and his wife Mary now
[illegible] or of right might or ought to have in the above bargain
premises by any ways or means and that the same by these presents is
hereby wholly invested [illegible] of the Thomas Massey his heirs and
assigns forever [illegible] the aforesaid Daniel Massey and Mary his
wife and their heirs [illegible] the above bargain premises in every
part and parcel thereof will forever warrant and defend against them the
aforesaid Daniel Massey and Mary his wife and that their heirs and
[illegible] and all manner of persons or persons whatever claiming by
from or under them or any of [illegible]; further the said Daniel Massey
and Mary his wife do agree to and with the said Thomas Massey his heirs
and assigns forever that if the whole or any part of the aforesaid
parcel should be lawfully taken away by any survey joining the said land
at any time thereafter that the aforesaid Daniel Massey as Mary his
wife their heirs or assigns shall and hereby shall and are hereby
obliged to return and make good the right to the quantity of land so
taken away and [illegible] as good to the aforesaid Thomas Massey and
his heirs provided the aforesaid Daniel Massey or his heirs have so much
land or if otherwise the Daniel Massey and Mary his wife and their
heirs do agree to pay to this aforesaid Thomas Massey's heirs or assigns
the sum of 30 pounds current money. In witness whereof he aforesaid
parties to these presents have set their hands and seal the day and year
first above written. Daniel Massey Sealed and delivered in the presence of George Skirvan and Gideon Pearce. The words survey and joining the said land were interlined before signing and delivery. On the back of the preceding deed was endorsed as follows viz.: Kent County [illegible] May 12, 1735. Came the within Daniel Massey before us, two of his Lordship's justices of the peace for the aforesaid County and acknowledged the within deed and the land and premises therein mentioned onto the within Thomas Massey his heirs and assigns forever. George Skirvan June 20, 1735: Received of Thomas Massey the sum of four shillings sterling being for the alienation of the within mentioned land. James Harris Received the within conveyance to be recorded in the records of Kent County according to act of assembly in such case lately made and provided.
