August 28, 1753: David Witherspoon, gentleman, of Newcastle County buys for £80 10/- from James Wrightson, gentleman, of Talbot County in Maryland a 139.5 acre part of Angels Rest lying between the Sassafras River and Chester River and between the other portions belonging to Jacob Gibson and to John Carslake: Beginning at the end of the North line of John Carslake's part of Angels Rest according to a partition thereof lately made, and running thence North fifty three perches and one quarter of a perch, then West four hundred and twenty perches, then South fifty three perches and one quarter of a perch, thence with a straight line to the beginning. This indenture
made the twenty eighth day of August in the year of our Lord seventeen
hundred fifty and three between James Wrightson of Talbot County,
gentleman of the one part and David Witherspoon of New Castle County,
gentleman of the other part. Witnesseth that the said James Wrightson
for and in consideration of the sum of eighty seven pounds ten shillings
current money to him in hand paid by the said David Witherspoon the
receipt whereof he doth hereby acknowledged he the said James Wrightson
hath granted bargained sold aliened enfeoffed released and confirmed and
by these presents do grant bargain sell alien enfeoff release and
confirm unto the said David Witherspoon his heirs and assigns forever
all that parcel of land being part of a tract of land lying in King
County in the province of Maryland between the Sassafras and Chester
Rivers called Angels Rest the aforesaid granted parcel thereof lying
between John Carslakes and Jacob Gibson's part of the aforesaid tract.
Beginning at the end of the North line thereof lately made and running
thence North fifty three perches and one quarter of a perch then West
four hundred twenty perches thence South fifty three perches and one
quarter of a perch thence with a straight line to the beginning
containing and laid out for one hundred thirty nine acres and one-half
acre of land more or less with all houses buildings edifices orchards
gardens meadows easements profits and advantages and hereditaments
whatsoever to the land granted parcel of land belonging and the
reversion and reversions remainder and remainders rents and services
thereof with the appurtenances and also all estate right title interest
claim or demand whatsoever either in law or equity of him the said James
Wrightson of in or to the same granted parcel of land and premises with
the appurtenances and every part thereof to have and to hold all and
singular the aforesaid granted parcel of land and premises with the
appurtenances and every part thereof unto the said David Witherspoon his
heirs and assigns forever to the only proper use and behoof him the
said David Witherspoon his heirs and assigns forever and the said James
Wrightson for himself his heirs doth hereby covenant and grant to and
with the said David Witherspoon his heirs and assigns that he the said
James Wrightson now is lawfully and rightfully seized in his own right
of a good sure and perfect estate of inheritance in fee simple of and in
all the aforesaid granted parcel of land and premises in every part
thereof with the appurtenances without any manner of condition mortgage
limitation of or uses or other matter or thing to alter change charge or
determine the same and also that he the said James Wrightson now hath
good rightful power and lawful authority to grant bargain sell and
convey all the parcel of land and premises with the appurtenances unto
him the said David Witherspoon and his heirs and assigns [illegible]
proper use of him the said David Witherspoon his heirs and assigns
forever and the said James writes for himself and his good [illegible]
to further grant and covenant to and with the said David Witherspoon his
heirs and assigns that he the said James Wrightson and his heirs the
said granted parcel of land and premises with the appurtenances and any
part thereof as well against himself and his heirs as against and any
and every of the heirs of a certain Brian O'Mealey and against any
person claiming or to claim by from or under them or any of them shall
warrant and forever defend by these presents unto the said David
Witherspoon his heirs and assigns forever. In witness whereof the said
parties to these presents have hereunto interchangeably set their hands
and seals the day and year first above written. James Wrightson Sealed and delivered in the presence of: Bedingfield Hands Charles Scott Kent County [illegible]: be it remembered that on the 28th day of August seventeen hundred fifty and three personally came before us two of his Lordship's justices of the peace for the county aforesaid James Wrightson the grantor within named and did acknowledge the within deed of bargain and sale to be his act and deed and the lands and premises therein mentioned to be the right and estate of the within named David Weatherspoon his heirs and assigns forever according to the purport of the within deed and at the same time also came Sarah the wife of the said James Wrightson and being by us privately examined out of the hearing of her said husband did declare that she made the said acknowledgment freely without being induced thereto by fear of ill usage from her said husband or for fear of his displeasure. Acknowledged before us, Bedingfield Hands Charles Scott Received of Mr. David Weatherspoon the sum of eighty seven pounds ten shillings current money being the consideration money within mentioned this 28th day of August Anno Domini 1759.
