May 12, 1735
(Recorded June 20, 1735): Daniel Massey, carpenter, and Mary his wife of
Kent County in Maryland sell for twenty pounds a 100-acre part of the
tract called Partnership,
located on the North side of Chester [River] near the Pudding Branch to
Thomas Massey, planter, also of Kent County. Acting for the Crown: James
Harris and Justices of the Peace George Skirvan and Gideon Pearce;

[Kent County:] This indenture made this twelfth day of May in the year
of our Lord one thousand seven hundred and thirty five. Between Daniel
Massey of Kent County and province aforesaid, carpenter, and Mary his
wife of the one part, and Thomas Massey of the said county and province,
planter of the other part. Witness that the aforesaid Daniel Massey and
Mary his wife for and in consideration of the sum of thirty pounds
current money to them in hand paid, the receipt whereof he, the said
Daniel Massey and Mary his wife, doth acknowledge thereof every part and
parcel themselves to be fully satisfied, contained, and paid of every
part and parcel thereof doth fully, clearly, and absolutely acquit and
discharge the said Thomas Massey, his heirs and assigns, forever and by
these presents hath given, granted, bargained, sold, aliened, enfeoffed,
transferred, and confirmed and by these presents do fully, clearly, and
absolutely give, grant, bargain, sell, alien, enfeoff, transfer, and
confirm unto the said Thomas Massey, his heirs and assigns, forever part
of a tract of land called Partnership, situated and being upon the
North side of Chester in the county aforesaid: Beginning at a small
Spanish oak marked with nine notches standing near the head of a stream
which proceeds out of a branch called Pudding Branch running North two
hundred and forty eight perches, thence South thirty one degrees West
one hundred and eight perches, thence South twenty five degrees West
forty two perches, thence South fourteen degrees West one hundred and
twenty four perches, thence with a straight line to the first tree,
containing and laid out for one hundred acres more or less, together
with all woods, under woods, trees, timber trees, meadows, water
courses, and all and singular other the rights, profits, benefits, and
privileges and all and singular other the appurtenances to the same
belonging or in any ways appertaining. To have and to hold the said part
of a tract of land with the appurtenances thereunto belonging unto the
said Thomas Massey, his heirs and assigns, forever more and the
aforesaid Daniel Massey and Mary his wife and heirs do covenant, grant,
and agree to and with the said Thomas Massey, his heirs and assigns,
that he, the said Daniel Massey and Mary his wife, at the sealing and
delivery thereof hath good rightful power and lawful authority to sell
and convey the same and that the above bargained premises and every part
and parcel thereof are free and clear from all former gifts, grants,
bargains, sales, leases, jointures dowers, or title of dower, rents,
discharges, arrearages of rent, fines, forfeitures, arrears, arrears of
rents had, made, or committed or done or suffered to be done by the
aforesaid Daniel Massey and Mary his wife or by any other persons
whatsoever by their means or procurement the rents and services from
henceforth growing due and payable to the chief Lord or Lawrence of the
Proprietary or fees only excepted and foreprized and the said Daniel
Massey and Mary his wife doth by these presents forever quitclaim and
release all the right, title, and interest, property claim, demand he,
the said Daniel Massey and or Mary his wife, now have or of right might
or ought to have in the above bargained premises by any ways or means
and that the same by these presents is there hereby wholly invested in
and upon the aforesaid Thomas Massey, his heirs and assigns, forever;
and further that the aforesaid Daniel Massey and Mary his wife and their
heirs the above bargain premises in every part and parcel thereof will
forever warrant and defend against them, the aforesaid Daniel Massey and
Mary his wife, and heirs and any manner of person or persons whatsoever
claiming by from or under them or any of their and further the said
Daniel Massey and Mary his wife do agree withThomas Massey, his heirs
and assigns, forever that if the whole or any part of the aforesaid
should be lawfully taken away by any survey, or joining of the said land
at any time hereafter, that them the aforesaid Daniel Massey and Mary
his wife, their heirs, or assigns shall and are hereby obliged to return
and make good right to the quantity land so taken away in a quality as
good to the aforesaid Thomas Massey and his heirs provided the aforesaid
Daniel Massey or his heirs have so much land or if otherwise the
aforesaid Daniel Massey and Mary his wife and their heirs do agree to
pay the aforesaid Thomas Massey, his heirs or assigns, the sum of thirty
pounds current money. In witness whereof the parties to these presents
have set their hands and seals the day and year first above written. Daniel Massey {seal}
Sealed and delivered in presence of George Skirvan Gideon Pierce {The words, "survey" and "joining the said land," were interlined before signing and delivery. On the back of the preceding deed was endorsed as follows viz.: Kent County aforesaid: May 12, 1735 came the within Daniel Massey before us, two of his Lordship's Justices of the Peace for the aforesaid county and acknowledged the within deed and the land and premises therein mentioned unto the within Thomas Massey, his heirs and assigns, forever. Gideon Pearce June 20, 1735: Received of the aforesaid Thomas Massey the sum of four shillings sterling, being for the alienation of the within mentioned land. James Harris
Received the within conveyance to be recorded in the records of the aforesaid county according to act of assembly in such cases lately made and provided. Witness my hand this 20th day of June Anno Domini 1735. James Smith, clerk
