Joshua M. Massey to Emily Ann Massey, January 16, 1823

August 8, 1822 (Recorded January 16, 1823): Emily Ann Massey of Kent County in Maryland buys for $3,696.00 the combined 154 acres of parts of the tracts, Angel's Rest, Angel's Lot, Partnership, and Spring Garden from Joshua W. Massey of Queen Anne's County in a land swap between Ebenezer T. Massey and Emily Ann Massey of Kent County and Joshua W. Massey and Pamela Lambden Massey of Queen Anne's County, said swap being made possible by Act of the Legislature of Maryland passed February 21st, 1822, Chapter 164, and endorsed as to the equivalence in value of the lands by a commission formed of James Parker, Mr. Osborne, and William Moffitt. [Kent County, Maryland]: Be it remembered that,on the sixteenth day of January eighteen hundred and twenty three, a deed was brought to be enrolled among the land records of Kent County the tenor where of [illegible] following words to wit: This indenture made and executed the eighth day of August, eighteen hundred and twenty two, between Joshua W. Massey of Queen Anne's County and State of Maryland of the one part and Emily Ann Massey of Kent County in the state aforesaid of the other part.  Witnesseth that the said Joshua W. Massey for and consideration of the amount of three thousand six hundred and ninety six dollars current money of the United States to him in hand paid by the aforesaid Emily Ann Massey before the sealing and delivery of these presence the receipt thereof has been acknowledged by the said Joshua Massey doth hereby acknowledge [illegible] every part or parcel thereof to the [illegible phrase] and discharge the said Emily Ann Massey, her heirs, executors, and administrators [illegible words] Joshua W. Massey hath granted, bargained, sold, aliened, enfeoffed, and confirmed and the said Joshua M. Massey hath granted bargained sold aliened, enfeoffed, and confirmed by these presents doth grant, bargain, sell, alien, enfeoff, and confirm unto the said Emily Ann Massey, her heirs and assigns, parts of the several tracts or parcels of land lying and being in Kent County and State of Maryland, which are called and known by the following names to wit: part of a tract of land called Angel's Rest, part of a tract of land called Angel's Lot, part of a tract of land called Partnership, and part of a tract of land called Spring Garden, which said tracts or parcels of land are contained within the following described lines and bounds: Beginning at the end of the third line of Angels Rest and running thence South fifty one and one quarter degrees [illegible] three hundred and thirty two perches until it intersects the eleventh line of the survey made by Thomas Gale for Benjamin Massey, thence with the said survey South eighty one degrees East ninety four perches, thence South seventy five degrees East sixty and one fourth perches, thence North twenty six and three fourths degrees East fourteen and one fourth perches, thence South seventy three degrees East twelve and three fifths perches, thence North twenty eight degrees East one hundred eighty and one half perches, thence North thirty five degrees East sixty one and one fourth perches, thence to the beginning North fifty nine degrees West thirty five and one sixteenth part of a perch, containing and now laid out for one hundred and fifty four acres and six perches of land, be it the same more or less together with all and singular the buildings improvements woods, ways, waters and waterways, rights and liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging and every and anywise appertaining and the reversion and reversions, rents, issues, and profits [illegible] estates, rights, title, and interest whatsoever of him, the said Joshua W. Massey, both in law and equity of in to and out of the said tract or parcels of land and premises herein bargained, sold, mentioned, or intended hereby so to be,every [illegible] part and parcel thereof to have and to hold the said tracts or parcels of land so as aforesaid described [illegible] as aforesaid together with the buildings and appurtenances and all and singular the other premises hereby bargained and sold or [illegible] mentioned or intended hereby as to be in every part and parcel thereof with this and every of their appurtenances unto the said Emily Ann Massey, her heirs and assigns, forever and to [illegible] for no other use, intent, or purposes whatsoever and the said Joshua W. Massey for himself, his heirs, executors, and administrators, doth hereby covenant, grant, promise, and agree to and with the said Emily Ann Massey, her heirs, executors, administrators, or assigns, that he, the said Joshua W. Massey and his heirs, said tract or parcel of lands and premises hereby granted, bargained, and sold in every part or parcel thereof with the appurtenances thereunto belonging to her, the said Emily Ann Massey, her heirs and assigns, against him, the said Joshua W. Massey and his being [illegible words] and may [illegible] whatsoever and claiming any right, title, [illegible] and into the same or any part thereof shall and will warrant and these send and forever defend by these presents. In testimony whereof the said Joshua W. Massey hereunto subscribed his name and affixed his seal the day and year as first above written.

Kent County, to wit: Received this eighth day of August the day of the within deed of and for the within named Emily A. Massey the sum of three thousand nine hundred and ninety six dollars current money of the United States being the consideration mentioned in the within deed.

Maryland Kent County: On the eighth day of August, in the year of our Lord one thousand eight hundred and twenty two, personally appeared Joshua W. Massey of the county and state aforesaid, being the party grantee [illegible line] aforesaid and acknowledged the within deed to be his act and [illegible] in the land wherein granted to be the [illegible phrase] and [illegible] bargained and sold to be the property right and the state of the within named Emily Ann Massey, her heirs and assigns, forever according to the true purport and meaning of the within deed and acts of assembly in such cases made and provided; and also at the same time personally appeared Pamela L. Massey, wife of the said Joshua W. Massey, before us, the subscribers, two of the Justices of the Peace for the county and state aforesaid, and acknowledged the said deed or instrument of writing to be her act and deed and the land and premises therein mentioned to be the right and estate of the within named Emily Ann Massey, her heirs and assigns, forever; and the said Pamela L. Massey, being by us privately examined apart from and out of the hearing of her husband whether she does make her acknowledgment willingly and freely without her being induced thereto by force or threats of ill usage by her husband or fear of his displeasure acknowledged that she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of ill usage by her husband or fear of his displeasure. [illegible] by an act of the Legislature of Maryland passed February 21st, 1822, Chapter 164, entitled an act for the benefit of Ebenezer T. Massey and Emily Ann Massey of Kent County to enable them to convey to Joshua W. Massey of Queen Anne's County a tract of land lying in Queen Anne's County in exchange for land of equal value lying in Kent Count, we the subscribers were [illegible] to view and value the land before said and to endorse the deed given by the said Joshua to the said Emily and signifying our [illegible] that the lands conveyed by the said Joshua to the said Emily Ann are equal in value to the lands conveyed by the said Emily and to the said Joshua. Be it therefore known that we have reviewed and valued the lands as aforesaid and certify that we value the lands conveyed by the said Joshua to the said Emily and by the within deed are equal or greater in value then the lands conveyed by the said Emily unto the said Joshua. Witness our hands and seals this 12th day of August 1822:
