March 8, 1744: Samuel Massey, hatter of Chestertown in Kent County, buys for £40, 18/-, 7p. from William Stevenson, heir and brother of the late John Stevenson, weaver, of Chestertown, the two-thirds parts of Lott 67 in Chestertown in three equal parts to be divided, being the northmost two thirds parts of the lot and all that remains thereof over and above the third part thereof heretofore sold and conveyed by the same William to William Crane and divided therefrom by a line running northeast for the length of the same lot. Acting for the Crown and as witnesses: Justices of the Peace Charles Hynson and Bedingfield Hands; James Smith is Kent County clerk. |
This indenture
made this eighth day of March in the year of our Lord one thousand seven
hundred forty and four between William Stephenson of Kent County in the
province of Maryland, planter, brother and heir at law of John
Stephenson late of Chestertown in the same county, weaver, deceased of
the one part and Samuel Massey of Chestertown aforesaid, hatter of the
other part. Witnesseth that the same William for and in consideration of
the sum of forty pounds eighteen shillings and seven pence current
money of Maryland aforesaid by the same Samuel to the aforesaid John in
his lifetime paid and also for and in consideration of five shillings
like money by him the same Samuel to him the said William in hand
already paid the receipt of both which [illegible] the same William doth
hereby acknowledge have granted bargained sold aliened released
enfeoffed and confirmed and by these presents doth grant bargain sell
alien release enfeoff and confirm unto the same Samuel Massey his heirs
and assigns forever all that two thirds parts of the tenement and lot of
land situate and being in Chestertown aforesaid known and distinguished
by the number sixty seven in three equal parts to be divided between
the northernmost two thirds parts of the same lot and all that remains
thereof over and above the third part thereof hereto for so conveyed by
the same William to William Crane and divided therefrom by a line
running northeast for the length of the same lot together with all and
singular houses buildings easements emoluments tenements hereditaments
rights members and appurtenances whatsoever unto the said herein and
freely granted and bargained two thirds parts of the lot of land
aforesaid belonging or in any manner appertaining and also the reversion
and reversions remainder and remainders thereof and all the estate
right title interest claim property and demand whatsoever of him the
said William Stephenson of in into the same in every part and parcel
thereof to have and to hold all and singular the aforesaid herein before
mentioned granted in bargained two thirds parts of the lot of land
aforesaid with the premises and appurtenances thereunto belonging unto
him the same Samuel Massey his heirs and assigns forever to therefore
the only proper use of him the said Samuel his heirs and assigns forever
and the same William Stephenson for himself and his heirs to thereby
covenant promise grant and agree to and with this aforesaid Samuel
Massey his heirs and assigns that he the same William Stephenson and his
heirs all the aforesaid hereby granted bargained two thirds parts of
the tenement and lot of land aforesaid number sixty seven with the
premises and appurtenances thereunto belonging as well against himself
the same William Stephenson and his heirs are against all other person
persons whatsoever by from or under him or them claiming or who
thereafter shall claim any estate right or interest therein unto the
same Samuel Massey his heirs and assigns shall and will warrant and
forever by these presents defend. In witness whereof the parties
aforesaid had to these presents interchangeably set their hands and
seals the day and year first above written. William Stephenson Sealed and delivered in presence of: Charles Hynson Samuel Greene, Junior Memorandum: That on the eighth day of March Anno Domini seventeen hundred and forty and four the within named William Stephenson the grantor appeared personally before the underwritten two of his Lordship's the Right Honorable the Lord Proprietary's justices of the peace for Kent County and voluntarily acknowledged the within written deed of bargain and sale to be his act and deed and the two thirds parts of the tenements and lot of land with the appurtenances therein mentioned to be granted and bargained to be by virtue thereof the right and the state of Samuel Massey within named according to the tenor and effect of the same deed and at the same time came Hannah the wife of the said William and acknowledged her assent to the same deed and being privately examined out of the hearing of her husband declared and said that she made the same acknowledgment willingly and freely and without being induced thereto by fear or threats of or ill usage from her husband or fear his displeasure.
