100 acres, part of Massey's Venture, March 17, 1718

March 17, 1718: Edward Holoday, planter, of Kent County in Maryland buys for 3,000 pounds of tobacco a 100 acre part of Massey's Venture, adjacent to Well Meaning, from Peter Massey.  Acting for the Crown: Samuel Luivezant, Sam. Wallis, John March, and M. Tilden; James Smith, Clerk of Kent County.
Maryland etc. this indenture made 17th March Anno Domini one thousand seven hundred and eighteen between Peter Massey of Kent County, planter of the one part and Howard Holoday, planner of the other part. Witnesseth that the said Peter Massey for and in consideration of the sum of three thousand pounds of tobacco to him in hand already paid and seized to be paid the receipt whereof he the said Peter Massey doth hereby acknowledge thereof acquit and discharge the said Holoday, his heirs, executors, administrators, or assigns and by these presents have given, granted, bargained, sold, aliened,enfeoffed, and confirmed and by these presents do give, grant, bargain, sell, alienate, enfeoff, and confirm unto Edward Holoday, his heirs, executors, administrators, or assigns one hundred acres of land being part of a tract of land called Massey's Venture. Beginning at a bounded white oak being the easternmost bounded tree of a parcel of land call Well Meaning and the beginning tree of Massey's Venture and running from the said tree North sixty two degrees [illegible] two hundred and twelve perches thence North East seventy seven perches thence South sixty two dgrees East two hundred and twelve perches thence to the aforesaid bounden white oak lying and being in Kent County near the Cypress Branch, containing and laid out for one hundred acres more or less together with all houses, fencing, orchards, woods, underwoods, ways, water, trees, and timber trees, and also all other profits, privileges whatsoever to the said land belonging or in any ways appertaining. To have and to hold the same the said parcel of land according to the bounds aforesaid unto the said Edward Holoday, his heirs, executors, administrators, and assigns, forever and the said Peter Massey for himself, his heirs, executors, and administrators do covenant in manner and form following that he the said Peter Massey is the true and lawful owner of the premises and that at the sealing and delivery of these presents is lawfully [illegible] to the use of him and his heirs, executors, administrators, and assigns, forever and that he the said Peter Massey have full power and lawful authority to give, grant, bargain, and sell the ...

... charge of the said Edward Holoday, his heirs or assigns, make any further assurance of the premises as his or their counsel learned in the law shall reasonably advise or direct and further the said Peter Marcy doth for himself, his heirs, executors and administrators doth covenant to and with the said Edward Holoday, his heirs and assigns, that he shall and may from time from henceforth lawfully and quietly have, hold, occupy, possess, and enjoy all and singular every part of the parcel of land aforesaid and the premises thereunto belonging or any ways appertaining and also may take and receive the rents and profits of the same from time to time and [illegible] forever hereafter to the only use of him the said Edward Holoday, his heirs or assigns, forever without any lett, hindrance or disturbance of the said Peter Massey, his heirs, executors or administrators, or any other person or persons whatsoever. In confirmation whereof the said Peter Massey hath hereunto set his hand and seal the day and year above written.

Memorandum: Between the eighth and ninth line is this word entered, tree, and between the nineteenth and twentieth line the word, entered fore, before sealing and delivery.

On the back of the preceding instrument of writing was endorsed as follows: Kent County in Maryland March the 17th day 1718.  Then came Peter Massey before us, two of His Lordship's Justices for Kent County, and acknowledged the within conveyance to be his act and deed for the use
within mentioned. With our hands the day and year above written.

Memorandum: The conveyance on these sheet of papers within writ received from the hands of the within Edward Holoday to be recorded in the record of Kent County and according to act of assembly in such cases made and provided. Witness my hand this eighteenth day of March Anno Domini 1718.
