August 12, 1749 (recorded
October 24, 1749): Peter Massey of Kent County in Maryland for 3,000
pounds of tobacco buys a 25 acre parcel called The Forest
from John Wright and wife Nollar. Witnesses: Jervis Spencer and
S. Wilmer; recorded by James Smith, Kent County Clerk. Acting for
the Crown: George Garnett. |
This indenture made this twelfth
day of August in the year of our Lord Christ one thousand seven hundred and forty nine between John Wright
of Queen Anne's County in the Province of Maryland of the one part and
Peter Massey of Kent County in the province aforesaid planter of the
other part. Witnesseth that the aforesaid John Wright for and in
consideration of the sum of three thousand pounds pounds of tobacco by him the said
Peter Massey before the execution of these presents in hand paid the receipt whereof the said John does hereby acknowledge
and thereof doth acquit and discharge the same Peter, his heirs,
executors, and administrators, forever and for diverse other good causes
and consideration him thereunto moveing has given, granted, bargained,
and sold, aliened, enfeoffed, released, and confirmed and by these
presents to us for himself and his heirs fully, freely, and absolutely give,
grant, bargain, sell, alien, enfeoff, release, and confirm unto him the
said Peter twenty five acres of land, part of a tract of land called The Forest,
lying and being in Kent County aforesaid, devised by him the said John
unto the said Peter, his heirs, and assigns, together with all and singular
the houses, buildings, orchards, gardens, tenements, hereditaments,
improvements, and appurtenances thereunto belonging or in any manner appertaining, which the
said Peter hath in possession included with his wife's part of said
tract of land by [illegible] terms agreed upon by and between the said
John Wright and Nollar, wife to said Peter Massey and their heirs
forever with the appurtenances thereunto belonging twenty five acres of
land, premises, and appurtenances and every part and parcel thereof unto
him the said Peter Massey, his heirs, and assigns, forever to and for the
only proper use of him the said Peter Massey, his heirs, and assigns,
forever and the same John for himself, his heirs, executors, and
administrators, does hereby covenant and agree to and with the said Peter,
his heirs, and assigns, that they shall and may all at all times
hereafter peaceably and quietly have, hold, use, occupy, and enjoy all the
aforesaid twenty five acres of land as aforesaid with the premises and appurtenances thereunto belonging as his and
their proper estate and to his and their proper use without any
molestation or interruption of him the said John his heirs or any under
him or them claiming any right, title, or interest to the aforesaid twenty five
acres of land as aforesaid with the appurtenances thereunto belonging as
well against him the said John and his heirs as against all
other person or persons whatsoever unto him the said Peter,
his heirs, and assigns, shall and will warrant and forever by these
presents defend. In witness whereof the parties aforesaid have to
these presents interchangeably set their hands and seals the day and

Sealed and delivered in the presence of Jerves Spencer S. Wilmer Received of Peter Massey the sum of three thousand pounds of tobacco, consideration within mentioned. Received this 12th day of August 1749. John Wright
[illegible] Haley Be it remembered that on this 12th day of August 1749 came the within mentioned John Wright the grantor before us, the subscribers, two of His Lordship's Justices of the Peace for Kent County and did acknowledge the land and premises wherein mentioned to be the right, title, interest, and estate of Peter Massey the within grantee, his heirs, and his heirs and assigns, forever.
