Daniel Clark to Samuel Massey, October 29, 1751

October 29, 1751 (recorded November 11, 1751): Samuel Massey, inholder, of Queen Anne's County in Maryland for 90 pounds buys a quarter part of Plot 40 in Chestertown, said plot being the part sold to Daniel Clark (the seller, working as a hatter) and wife Elizabeth by his father George Clark.  Witness: Charles Scott, [illegible] Hands and Lycos. Skirven.  Acting for the Crown: George Garnett; James Smith, Kent County Clerk.
This indenture made this seventeenth day of July in the year of our Lord Christ one thousand seven hundred and fifty one. Between Daniel Clark of Chester Town in Kent County, hatter, and Elizabeth his wife of the one part and Samuel Massey of Queen Anne's County, inholder, of the other part. Witnesseth that the said Daniel Clark for and in consideration of the sum of ninety pounds current money of Maryland to him in hand paid by the aforesaid Samuel the receipt whereof the said Daniel does hereby acknowledge have granted, bargained, sold, aliened, and confirmed and by these presents does grant, bargain, sell, alien, and confirm unto the said Samuel Massey, his heirs, and assigns, forever all that messuage, tenement, and quarter part of a lot of land situate lying and being in the town of Chester being part of the lot of the same town distinguished in the survey of the same town by the number 40, being that part of the same lot which was sold me by my father George Clark as by the deed thereof remaining on the records of Kent County may appear together with all houses, buildings, gardens, lands, easements, and advantages whatsoever onto the same quarter part of a lot belonging or in any wise appertaining with the reversion and reversions, remainder and remainders, rents, and services of the premises and every part thereof and also all the estates, right, title, interest, claim, and demand whatsoever of him the said Daniel Clark of in and to the said messuage, tenement and part of a lot of land. To have and to hold the said messuage, tenement, and quarter part of a lot of land and all this and singular the said premises above mentioned in every part and parcel thereof with the appurtenances unto the said Samuel Massey, his heirs, and assigns, unto the only proper use and behoof of the said Samuel Massey, his heirs, and assigns, forever, free and clear, and freely and clearly acquitted of and from all other and former gifts, grants, sales, mortgages, leases or encumbrances whatsoever in the said Daniel for himself, his heirs, and assigns, the said messuage, tenement, and premises in every part thereof against him and his heirs and against all and every other person and persons whatsoever to the said Samuel Massey, his heirs, and assigns, shall and will warrant and by these presents forever defend. In witness whereof the parties aforesaid have hereto interchangeably set their hands and affixed their seals the day and year first above written.

Be it remembered that on the seventeenth day of July in the year of our Lord seventeen hundred and fifty one came the within Daniel Clark and Elizabeth his wife and acknowledged the within instrument of writing to be their their act and the land and premises thereon therein mentioned to be the right and property of the within mentioned Samuel Massey according to the true intent and meaning thereof, the said Elizabeth, being first privately examined, acknowledged that her assent thereto was without fear or threats of her said husband or for fear of his displeasure, before us, two of our and His Lordship's Justices of the Peace for Kent County. Witness our hands the day and year aforesaid.
