March 21, 1755: Daniel
Massey, inholder, of Kent County in Maryland for 280 pounds, 2 shillings
and 6 pence buys an 80 acre parcel called Angel's Rest (adjacent to and including a portion of Partnership,
and perhaps to be disputed by Bryant Amoly) from David Witherspoon,
Esquire, and wife Hester. Witnesses: J. Wilmer, Nicholas Smith. Acting for the Crown: Joseph Nicholson; James Smith, Kent County Clerk. |
This
indenture made this twenty ninth
day of November in the year of our Lord Christ one thousand seven
hundred fifty and four. Between
David Witherspoon of New Castle County upon Delaware, Esquire of the one
part and Daniel Massey of Kent County in Maryland, inholder of the
other part. Witnesseth that the aforesaid David Witherspoon for and in
consideration of the sum of two hundred and fifty eight pounds two
shillings and six pence current lawful money of Maryland to him in hand
paid by said Daniel Massey, the receipt whereof the said David
Witherspoon doth hereby confess and acknowledge, hath granted,
bargained, sold, aliened, released, and confirmed and by these presents
doth fully, freely and absolutely grant, bargain, sell, alien, release,
and conform unto the aforesaid Daniel Massey, his heirs, and assigns,
forever all that parcel of land being part of a tract of land called
Angels Rest, lying and being in Kent County on the North side of Chester
River. Beginning at the end of the third line of the [illegible]
original tract and running from thence North one hundred and twenty and
two perches, then West fifty and six perches to the great road leading
from [illegible] head of Sassafras River to the head of Chester River,
then South thirty degrees West with said road sixty perches then West
forty and six perches,, then South Seventy perches to the third line of
the [illegible] then running East to the beginning. Containing and laid
out for eighty acres of land more or less unto said Daniel Massey, his
heirs, and assigns, forever, together with all and all houses,
buildings, and improvements whatsoever to the said granted premises
belonging or in an wise appertaining and also the reversion and
reversions, remainder and remainders, rents, issues, profits, and
services of all and singular the aforementioned granted land and
premises with all the appurtenances thereunto belonging or in any wise
appertaining and also all the estate, right, titles,
interest, property, and claim or [illegible] in law or equity which the
said
David Witherspoon hath, might, or ought to have of in and to the
aforesaid granted land and premises with the appurtenances and whereas
disputes have been likely to arise on account of the lines of the
aforesaid Angels Rest interfering with the land of the said Daniel
Massey called Partnership now the aforesaid David Witherspoon doth
remiss,
release, and forever quitclaim unto said Daniel Massey, his heirs,
and
assigns, forever all the estate, right, title, or property, either in
law or
equity, which he the said David Witherspoon, his heirs, executors, or
administrators have, ought, or could have to that part of Angels Rest
lying and being within said Daniel Massey's claim of the aforesaid tract
of land called Partnership to have and to hold all and singular the
aforementioned bargained land and premises and every part thereof unto
him
the said Daniel Massey, his heirs, and assigns, forever to the only
proper
use and behoof him the said Daniel Massey, his heirs, and assigns,
forever
and also that he the said Daniel Massey, his heirs, and assigns, shall
and
may at all times forever hereafter peaceably and quietly have, hold,
occupy, posses,s and enjoy the aforesaid granted lands and premises
without the lett, hindrance, molestation, interruption, or denial of
him the said David Witherspoon, his heirs, executors, and
administrators,
and of all and every other person or persons who whatsoever claiming or
to claim any right, title, interest, or property by, from, or under him
the
said David Witherspoon, his heirs, executors, administrators, and by,
from, or under a certain Bryant Amoly, his heirs, and assigns, which
said
Bryant Amoly was deemed and reputed to be the person that first had a
right to said tract of land called Angels Rest from the High Hon. the
Lord Proprietary for said tract called Angels Rest against whom the said
David Witherspoon, his heirs, executors, and administrators, shall and
will
warrant forever by these presents defend unto him the said Daniel
Massey, his heirs, and assigns, forever. In witness whereof the
aforesaid
David Witherspoon have hereunto set his hand and affixed his seal the
day and year first above written. The word (in) between the tenth and eleventh [ illegible] of fourth line the word (two) between the fourth and fifth words of eleventh line the word (Lord) between the second and third words of thirty-sixth line interlined before the sealing and delivery thereof. Signed sealed and divorced in the presence of Wilmer and Nicholas Smith Maryland Kent County aforesaid. Be it known that on the 29th day of November in the year of our Lord one thousand seven hundred fifty and four the within named David Witherspoon the grantor and Hester, his wife, personally appeared before us, two of His Lordship's Justices of the Peace of said county (she being first privately examined by us) did acknowledge the within instrument to be their voluntary act and deed and the lands and premises therein mentioned to be granted to be the absolute right to property of the within mentioned Daniel Massey, his heirs, and assigns, forever. Nicholas Smith November 29, 1754. Then received of Daniel Massey the just sum of two hundred and fifty eight pounds two shillings and six pence being in full the consideration within mentioned. Received by me. David Witherspoon
Received of Mr. Daniel Massey three shillings and three pence sterling, an alienation fine on the within lands due to the Lord Proprietary and received for his use.
