March 19, 1771: Elijah Massey
of Kent County in Maryland buys for 250 pounds (of Pennsylvania money)
buys a 139.5 acre portion of a parcel called Angel's Rest
(other parts belonging to John Carlslocks and Jacob Galifons) from
Thomas Witherspoon and wife Susanna. Possible intervention by

This
indenture made this fifteenth day of December in the year one thousand
seven hundred and seventy. Between Thomas Witherspoon of Newcastle
County on Delaware of the one part and Elijah Massey of Kent County and
Province of Maryland of the other part. Witnesseth that
the said Thomas Witherspoon for and in consideration of the sum of two
hundred and fifty pounds current money of the Province of Pennsylvania
to him in hand paid by the said Elijah Massey, the receipt whereof he
does hereby
acknowledge, he the said Thomas Witherspoon has granted, bargained,
sold,
aliened, enfeoffed, released, and confirmed and by these presents doth
grant,
bargain, sell, enfeoff, release, and confirm unto the said Elijah
Massey, his heirs, and assigns, forever all that parcel of land being
part
of a tract of land lying in Kent County in the province of Maryland
between Sassafras and Chester Rivers called Angels Rest, the aforesaid
granted parcel thereof lying between John Carslocks and Jacobs Galifons
part of the aforesaid tract. Beginning at the end of the North
line of John Carslocks
part of Angels Rest according to a partition
thereof heretofor [illegible] and running thence North fifty three
perches and
one quarter of a perch thence East four hundred and twenty perches
thence South fifty three perches
and one quarter of a perch then with a straight line to the first
beginning, containing and now laid out for one hundred thirty nine and
one half of an acre of land more or less, and all houses, buildings,
edifices, orchards,
gardens, meadows, easements, profits, advantages, and hereditaments
whatsoever to the same granted parcel of land belonging or in
any wise appertaining to the same and the reversion and reversions,
remainder and remainders, rents and services thereof with the
appurtenances
and also all the estate, right, title, interest, claim, or demand
whatsoever
either in law or equity of him the said Thomas Witherspoon of in and
to the same granted parcel of land and premises with the
appurtenances in every part thereof to have and to hold all and singular
the aforesaid granted parcel of land and premises with the
appurtenances in
every part thereof unto the said Elijah Massey, his heirs, and assigns,
forever the only proper use and behoof of him the said Elijah Massey,
his
heirs, and assigns, forever and the said Thomas Witherspoon for himself
[and] his heirs does hereby covenant and grant to and with the said
Elijah
Massey, his heirs, and assigns, that he the said Thomas Witherspoon now
is
lawfully and rightfully seized in his own right of a good sure and
perfect estate of inheritance in fee simple open in all the aforesaid
granted parcel of land and premises in every part thereof with the
appurtenances without any manner of condition, mortgage, limitation of
use
or uses, or other matter or thing to alter, change, or determine the
same
and also that he the aforesaid Thomas Witherspoon now hath good rights,
full power, and lawful authority to grant, bargain, sell, and convey all
the
said parcel of land and premises with the appurtenances unto him the
said
Elijah Massey, his heirs, and assigns, to the only proper use of him the
said
Elijah Massey, his heirs, and assigns, forever and the said Thomas
Witherspoon for himself and his heirs does further grant and covenant to
and
with the said Elijah Massey, his heirs, and assigns, that he the said
Thomas Witherspoon and his heirs the said granted parcel of land and
premises with the appurtenances in every part thereof as well himself
and his heirs is against all and every of their heirs of a certain Bryan
Omeally and against any person or persons claiming or to claim by
from or under them or any of them as also against all manner of person
or
persons whatsoever laying any lawful claim to the same and the said
Thomas Witherspoon does further covenant, promise, grant, and agree to
and
with the said Elijah Massey, his heirs, and assigns, that he the said
Thomas
Witherspoon and his heirs at any time or times hereafter for the more
sure making and conveying of the aforesaid bargained land and premises
will
make, do, suffer, and acknowledge any further deed or deeds at the
proper
cost and charges in the law of him the said Elijah Massey, his heirs, or
assigns, as he the said Elijah Massey, his heirs, or assigns, or his or
their
counsel learned in the law shall advise, devise, or require. In
testimony
whereof the said Thomas Witherspoon hath hereunto set his hand and affixed his seal the day and year first above written. Be it remembered that the words, "and the said," between the thirty second and thirty third lines is also the word (any) between the thirty third and thirty fourth lines as also the words, "of him the said Elijah Massey, his heirs or assigns," was all interlined before the sealing and delivery of these presents and the word, "year," in the first line was as above. Signed sealed & delivered in the presence of us J Maxwell Samuel Thompson Received the 15th day of December 1770 of Elijah Massey the sum of two hundred and fifty pounds being the full consideration for the within bargained and sold premises. I say received. Thomas Witherspoon
Testis-Samuel Thompson Kent County aforesaid. Be it remembered that on the 15th day of December in the year one thousand seven hundred and seventy came before us, two of this Lordship's Justices of the Peace for the county aforesaid, Thomas Witherspoon the grantor within named and Susanna Witherspoon his wife, she being first privately examined out of the hearing of her said husband, and she declared that she made the same acknowledgment freely without being induced thereto from any threats or fear of ill usage of her said husband and the said Thomas Witherspoon and Susanna his wife do acknowledge the within land and premises to be the right and the estate of the within named Elijah Massey, his heirs, and assigns, forever according to the requests of an act of assembly in such cases made and provided. Received March 19, 1771 of Mr. Elijah Massey five shillings and seven
pence sterling as an alienation fine on the within land due to the Lord Proprietary and received for his uses.
