May 27, 1761: Elijah Massey, farmer, of Kent County in Maryland leases for 15 pounds per annum a 90 acre parcel called The Remains of My Lord's Gracious Grant (fomerly leased to the late Robert Ormond, and adjacent to John Brogan's land) from Dennis Dulany. This
indenture made this first
day of January in the year of our Lord Christ one thousand seven hundred
and sixty one. Between Dennis Dulany of Kent County in the province of
Maryland, engineer of the one
part, and Elijah Massey of the County aforesaid, farmer of the other
part. Witnesseth that said Dennis Dulany for and in consideration
of the
yearly rents and covenants hereafter mentioned to be done
and performed by the said Elijah Massey, his heir, executors, or
administrators, hath demised, set [illegible] to farm, let, and by these
presents doth demise set to farm let unto the said Elijah Massey ninety
acres of land part of a tract of land called The Remains
of My Lord's Gracious Grant, the said ninety acres formerly leased
onto a certain Robert Ormond, late of Kent County, which lease has since
expired by the death of those [illegible] therein mentioned and have
now become the property of the aforesaid Dennis Dulany to lease again.
Beginning at a marked hickory by a branch called Black Pudding Branch
and running from said hickory South thirty five perches and thence West
one hundred and five
perches then North one hundred and ten perches thence East one hundred
and sixty five perches to John Brogan's
land in South to Pudding Branch and down said branch to the first place
of beginning, containing ninety acres of land more or less. To have and
to
hold the aforesaid described premises and every part thereof unto him
the said Elijah Massey, his heirs, executors, administrators, or
assigns,
for and during the space and term of seven years commencing the first
day of this instant January fully to be completed and ending, yielding,
and paying therefore yearly and every year during
the term aforesaid, the full and just sum of fifteen pounds current
money aforesaid unto the said Dennis Dulany, his heirs, executors
administrators, or assigns, provided always that it shall not be lawful
for
the said Elijah Massey, his heir, executors, or administrators,
to let the premises or any part thereof without the knowing consent of
him
the said Dennis Dulany, his heirs, executors, administrators, or
assigns, for
it had obtained, and the said Dennis Dulany does hereby covenant,
promise, grant, and
agree for himself, his heirs, executors, and administrators, to
and with the said Elijah Massey, his heirs, executors, administrators,
or assigns, that he or they may freely make use of the premises
aforesaid in
all manner of ways that is common for a tenant to do, he the
said Elijah Massey, his heirs, or assigns, not making any waste on said
premises. In witness whereof he the said Dennis Dulany hath hereunto
set his hand and seal the day and year first above written. Dennis Dulany {seal}
Signed, sealed, and deliveredin the presence of William Rafin James Pearce To wit: On the first day of January one thousand seven hundred and sixty one came before us, two of the subscribers, being two of His Lordship's Justices of the Peace for Kent County, the within Dennis Dulany [illegible] did acknowledge the within deed or lease and everything therein contained to be his act and deed unto the within Elijah Massey the within lessee, his heirs, or assigns.
