Peter Massey to Col. Nathaniel Hynson, February 25, 1717


February 25, 1717 (recorded June 16, 1718): Col. Nathaniel Hynson, gentleman, of Kent County in Maryland for 12 pounds buys a 1,000 acre portion of a 3,000 acre tract called Partnership from Peter Massey and wife Sarah, daughter of Daniel Toas, Sr.  Witnesses: Edward Cosens, John Williams, and John Blackiston.  Acting for the Crown: James Kerry and Sam. Harris; James Smith, Kent County Clerk.
This indenture made the twenty fifth day of February Anno Domini one thousand seven hundred and seventeen and in the third year of the reign of our sovereign Lord George by the grace of God King of Great Britain, France, and Ireland, Defender of the Faith. Between Peter Massey and Sarah Massey his wife, daughter and heir of Daniel Toaes, Senior, late of Kent County in the Province of Maryland, deceased of the one part, and Col. Nathaniel Hynson of the aforesaid county and province, gentlemen of the other part. Witnesseth that the said Peter Massey and Sarah Massey his wife for and in consideration of the sum of twelve pounds current money of this province aforesaid to them in hand paid before the ensealing and delivery of these presents by the said Nathaniel Hynson the receipt whereof the said Peter Massey and Sarah his wife doth truly acknowledge and thereof and of every part and parcel thereof doth acquit, exonerate, and discharge the said Nathaniel Hynson, his heirs, executors, and administrators, hath granted, bargained, sold, aliened, and confirmed and by these presents doth grant, bargain, sell, alien, and confirm unto the said Nathaniel Hynson all the tract and parcel of land lying at the head of Chester River in the aforesaid County containing one thousand acres being part of a tract of land called partnership containing three thousand acres beginning at a marked hickory tree standing on the South West side of a plantation situate on the said land and running from the said tree North West three hundred and thirty one perches from thence North and by East one hundred and fifty seven perches from then [illegible] five hundred and fifty two perches from thence South one hundred and twenty perches from thence South West three hundred and seventy four perches from thence West to the first bounded tree containing one thousand acres with all the rights, titles, privileges, and appurtenances whatsoever to the said land in anywise appertaining or belonging and all this estate, right, title, interest, claim, and demand whatsoever to the said land appertaining or belonging with reversion or reversions, remainder or remainders, of all and singular the aforesaid bargained premises.  To have and to hold the same unto the said Nathaniel Hynson with all and singular the appurtenances to the said land belonging unto the said Nathaniel Hynson, his heirs, and assigns, to the only proper use and behoof of the said Nathaniel Hynson, his heirs and assigns, forever. And the said Peter Massey and Sarah his wife do hereby grant for themselves and their heirs that they and their heirs the said bargained tract of land with the appurtenances thereunto belonging unto this said Nathaniel Hynson and his heirs against all persons by from or under them or their heirs will warrant and defend against them and their heirs that the said Peter Massey and Sarah his wife doth covenant, promise, and grant to and with the said Nathaniel Hynson, his heirs, and assigns, by these presents in manner and form following (that is to say) that he the said Nathaniel Hynson now at the ensealing of these present indentures and may henceforth forever peaceably and quietly have, hold, occupy, possess, and enjoy the said bargained premises with their appurtenances without lawful let, trouble, denial, [illegible] or ejection, expulsion, or molestation of them the said Peter Massey and Sarah his wife further heirs.  In witness whereof they have hereunto set their hands and seals the day and year first above written.

On the back side of the preceding conveyance was endorsed as follows this: Maryland etc. This day to wit, the twenty seventh day of February Anno Domini one thousand seven hundred and seventeen came before me, James Kerry, one of the Lordship's Justices of the Province of Maryland, the within mentioned Peter Massey and Sarah his wife and did acknowledge the within deed of conveyance, she being first privately examined according to act of assembly, therein mentioned acknowledged for me the day and year above written.
