Abraham Woodland to Daniel Toas Massy [Massey], July 5, 1794

July 5, 1794: Daniel Toas Massey, farmer, of Kent County in Maryland for 5 shillings and settlement of various debts buys [back] a part of the tract called Partnership from AbrahamWoodland; i.e., Abraham can keep the land that he previously bought from Daniel if he pays the debts in the stated periodic installments.  Witnesses: John Thomas, and W. Thomas.  Ben Chambers is Kent County Clerk.
This indenture made the fourth day of March in the year of our Lord one thousand seven hundred and ninety four. Between Abraham Woodland of Kent County in the state of Maryland, farmer of the one part and Daniel Toas Massey of the county and state aforesaid, farmer of the other part. Witnesseth that the said Abraham Woodland in consideration of the several debts or sums of money due and owing to the said Daniel Toas Massey by the several bonds or obligations of the said Abraham Woodland as hereinafter mentioned and for the better securing the payment thereof with interest to the said Daniel Toas Massey, his executors, administrators, or assigns, according to the several conditions of the said bonds and also in consideration of the further sum of five shillings current money to him in hand paid by the said Daniel Toas Massey before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, he the said Abraham Woodland have granted, bargained, sold, aliened, enfeoffed, released, and confirmed by these presents to grant, bargain, sell, alien, enfeoff, release, and confirm unto the said Daniel Toas Massey, his heirs, and assigns, all that parcel of land situate lying and being in Kent County aforesaid being part of a tract of land called and known by the name of Partnership which was conveyed by the said Daniel Toas Massey to the said Abraham Woodland as by the said deed of the said Daniel Toas Massey to the said Abraham Woodland and bearing equal date with this indenture and recorded amongst the land records of Kent County reference being thereto had may more fully appear together with all and singular the houses, outhouses, buildings, gardens, orchards, improvements, ways, waters, hereditaments and appurtenances whatsoever to the same belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and services of the same and all the estate, right, title, interest, property, claim, and demand, both in law and equity, which he the said Abraham Woodland may or can have both in and to the same and every part thereof.   To have and to hold all and singular the above granted or intended to be granted lands and premises with the appurtenances to the said Daniel Toas Massey, his heirs, and assigns, to be and to him and their own proper use and behoof forever and the said Abraham Woodland for himself, his heirs, executors, and administrators, does hereby covenant to and with the said Daniel Toas Massey, his heirs, and assigns, that he the said Abraham Woodland and his heirs to all persons claiming under him or them shall and will at all times hereafter at the reasonable request and at the proper cost and charges of the said Daniel Toas Massey, his heirs or assigns, make, do, execute, suffer, or cause to be made, done, executed, and suffered such further and other act and acts, deed and deeds, thing and things, for the further and more effectual conveyance, assurance, and sure making of the hereby bargained and sold lands and premises with the appurtenances to the said Daniel Toas Massey, his heirs, and assigns, according to the true intent and meaning of this indenture as shall be by the said Daniel Toas Massey, his heirs or assigns, or his or their counsel learned in the law from time to time advised or directed to as such further conveyance or assurance contain no further covenant or warranty than in these presents is contained provided always and it is the true intent and meaning of these presents of the said parties hereunto that if the said Abraham Woodland, his heirs, executors, or administrators to it shall well and truly pay or cause to be paid to the said Daniel Toas Massey his heirs, executors, administrators, or assigns that the full and just sum of three hundred pounds current money on or before the twentieth day of this the present month of March which said sum of money is due and owing to the said Daniel Toas Massey by the said Abraham Woodland by bond bearing equal date with this indenture with legal interest on the same from the date of the said bond and if the said Abraham Woodland, his heirs, executors, or administrators, shall also well and truly pay or cause to be paid to the said Daniel Toas Massey, his heirs, executors, administrators or assigns, the further sum of five hundred nineteen pounds seventeen shillings and one farthing current money on or before the twenty fifth day of December next ensuing the date hereof also due and owing to the said Daniel Toas Massey by the said Abram Woodland by one other bond also bearing equal date with this indenture with the legal interest thereon from the date of the said bond and also the further sum of two hundred eighty pounds two shillings and eleven pence three farthings current money on or before the said twenty fifth day of December next ensuing the date hereof due and owing to the said Daniel Toas Massey by the said Abraham Woodland by one other bond which also bears equal date with this indenture with legal interest thereon from the date of the said bond and also the further sum of three hundred seventy nine pounds thirteen shillings and nine pence current money on or before the twenty fifth day of December which shall happen in the year of our Lord one thousand seven hundred and ninety five also due and owing to the said Daniel Toas Massey by the said Abraham Woodland by one other bond that bears equal date with this indenture with interest thereon from the date of the said bond and also the further sum of three hundred seventy nine pounds thirteen shillings and nine pence current money on or before the twenty fifth day of December which shall happen in the year of our Lord one thousand seven hundred and ninety six also due and owing to the said Daniel Toas Massey by the said Abraham Woodland by one other bond hearing equal date with this indenture with legal interest thereon from the date of the said bond and also the further sum of three hundred seventy nine pounds thirteen shillings and nine pence current money on or before the twenty fifth day of December which shall happen in the year of our Lord one thousand seven hundred and ninety seven due and owing to the said Daniel Toas Massey by the said Abraham Woodland by one other bond also bearing equal date with this indenture with legal interest thereon from the date of the said bond and also the further sum of three hundred seventy nine pounds pounds thirteen shillings and nine pence current money on or before the twenty fifth day of December which shall happen in the year of our Lord one thousand seven hundred and ninety eight due and owing to the said Daniel Toas Massey by the said Abraham Woodland by one other bond also bearing equal date with this indenture with legal interest thereon from the date of said last mentioned bond that then this present writing in every article, grant, and clause herein shall from thenceforth cease, determined and be void to all intents and purposes as if the same had never been made, anything herein contained to the contrary thereof notwithstanding. And the said Abraham Woodland for himself and his heirs, executors, and administrators, does hereby covenant, grant, and agree to and with the said Daniel Toas Massey, his heirs, executors, administrators, and assigns that he the said Abraham Woodland, his heirs, executors, and administrators shall and will well and truly pay the aforesaid several sums of money of aforesaid several in part recited bonds in the proviso aforementioned at the respective days and times in manner and form as in the aforesaid several in part recited bonds in the aforesaid presents mentioned as therein where limited and expressed without fraud or further delay. In witness whereof the said parties to these presents have here unto interchangeably set their hands and affixed their seals the day and year first above written.

seventeen hundred and ninety four personally appeared before us, the subscribers, two of the Justices of the Peace for Kent County aforesaid the within named Abraham Woodland and acknowledged the within instrument of writing to be his act and deed and the lands and premises therein granted with the appurtenances to be the right and estate of the within mention Daniel Toas Massey, his heirs, and assigns, forever, subject to the proviso herein mentioned according to the true intent and meaning of the same deed. Witness our hands the day and year above written.
