February 20, 1801: Benjamin Massey of Kent County in Maryland for 500 pounds buys a 120 acre parcel called Angel's Lott
(adjoined by land of John Gibson) from William Geddes, Esquire, and
wife Mary (represented by John Thomas, Esquire) of Philadelphia, who
inherited the land from Simon Wilmer, father of Mary (nee Wilmer)
Geddes. Witnesses: Margaret Geddes, William H. Jester, and Edward
Shippen, whose signature was attested to by Pennsylvania Governor Thomas
McKean and in turn by James Trimble, Acting Secretary to the Governor;
and John Comegys and Ia. Parker. Another transaction involved land
devised to William Geddes by John Pryon of New Castle County,
Delaware. Thomas Worrell is Kent County Clerk. |
This
indenture made the ninth
day of November in the year of our Lord one thousand seven hundred and
ninety nine. Between William Geddes of
the City of Philadelphia, late of New Castle County and the State of
Delaware, Esquire and Mary his wife of the one part and Benjamin Massey
of Kent County in the state of Maryland, farmer of the other part.
Witnesseth that the said William Geddes and Mary his wife in
consideration of five hundred pounds lawful money of Maryland to them in
hand
paid by the said Benjamin Massey before the execution of this indenture,
the receipt of which is hereby acknowledged, have granted, bargained,
sold,
aliened, enfeoffed, released, and confirmed and do hereby grant,
bargain, sell,
alien, enfeoff, release, and confirm unto the said Benjamin Massey, his
heirs, and assigns, all that tract or parcel of land called Angels Lott
situate in Kent County in Maryland aforesaid which was heretofore
devised
to the said William Geddes and Mary his wife by Simon Wilmer, late of
Kent County aforesaid, deceased father of the said Mary, as by the last
Will and Testament of the said Simon Wilmer, reference being thereunto
had may more fully appear, which said land lies adjoining to land late
of John Gibson, deceased, and of Elijah Massey, and was since the devise
aforesaid conveyed by deed from a certain John Pryon of New Castle
County aforesaid to the said William Geddes or to the said William
Geddes and Mary his wife as by the said deed reference being
thereunto had may more fully appear containing by estimation one
hundred and twenty
acres be the same more or less together with all the houses, buildings,
yards, gardens, orchards, improvements, fences, ways, water, waters,
watercourses,
services, emoluments, hereditaments, and appurtenances to the same
belonging or in any wise appertaining and the reversion and reversions,
remainder and remainders, rents, issues, and profits thereof and all the
estate,
right, title, interest, and land, property, claim and demand
whatsoever both at law and in equity of them this said William Geddes
and Mary his wife or either of them in or onto the same. To have
and to hold the said lands and premises with the appurtenances to the
said Benjamin Massey, his heirs, and assigns, his and their only
proper use and behoof forever and the said William Geddes and Mary his
wife for themselves and each of them and each of their heirs,
executors, and administrators hereby covenant with the said Benjamin
Massey, his heirs, and assigns, that they the said William Geddes and
Mary
his wife and each of them their and each of their heirs and
administrators hereby covenant with the said Benjamin Massey, his heirs
and assigns that they the said William Geddes and Mary his wife and each
of them and their and each of their heirs against all persons claiming
or to claim the said land and premises
with the appurtenances by from or under them or either or any of them
shall and will warrant and by these presents forever defend and further
that they the said William Geddes and Mary his wife and each of them
there and each of their heirs shall and will at any time hereafter
affirm the reasonable request and at the costs and charges in the law of
the said Benjamin Massey, his heirs or assigns make or execute or
suffer to be made done, executed, and suffered such further and other
acts, deeds, things, assurances, and conveyances in the law for the
better and more perfect [illegible] of the above described land and
premises with the appurtamces , his heirs, or assigns, or his or their
learned counsel reasonably advised or required, and this indenture
further witnesseth that the said William Geddes hath appointed and doth
hereby appoint James Scott, Esquire, attorney at law, and John Thomas,
physician, both of Kent County aforesaid jointly and severally his
lawfull attorney and attorneys with full power to them or either of them
to appear in any court or before any judge or judges, justice or
justices authorized by the law of Maryland to take an acknowledgement of
this indentureand to acknowledge this indenture as the act an deed of
the said William Geddes in order that the same might be recoded
according to law. In witness whereof the said parties to this
indenture have hereunto interchangeably set their hands and offered
their seals on the day and year first above written. William Geddes {seal}
Sealed and deliveredMary Geddes {seal} in the presence of us Margaret Geddes William H. Jester State of Pennsylvania to wit: On the ninth day of November in the year of our Lord one thousand seven hundred and ninety nine before me, Edward Shippen, Esquire, one of the Justices of the Supreme Court of Pennsylvania, personally appeared Mary Geddes, a party to the above written indenture, the wife of William Geddes of the City of Philadelphia, Esquire, and acknowledged the said indenture as her act and deed, and I hereby certify that the said Mary Geddes was examined by me personally out of the hearing of her husband, whereupon she declared that she made her said acknowledgement willingly and freely without being induced thereto by fear or threats of ill usage by her husband or fear of his displeasure. Taken and certified on the day and year aforesaid in testimony whereof I have hereunto set my hand and seal. Edward Shippen {seal}
Pennsylvania: Thomas McCean Gov. of the Commonwealth of Pennsylvania to all to whom these presents shall come: Greeting: Know ye that Edward Shippen, Esquire, whose name is subscribed to the instrument of writing hereunto annexed was at the time of subscribing the same, one of the Justices of the Supreme Court of the said Commonwealth, duly appointed and confirmed and full faith and credit is and ought to be given to him accordingly.
Maryland Kent County, etc. On the twenty second day of October in the year of our Lord one thousand eight hundred and eight before us, the subscribers, two of the Justices of the Peace for Kent County, personally appeared John Thomas, one of the attorneys named and appointed by the within indenture and by virtue of the power to him within given acknowledged the said indenture as the act and deed of the within named William Geddes in order that the same may be recorded according to law. Ia. Parker Kent County State of Maryland: Whereas William H. Jester one of the subscribing witnesses to the foregoing instrument of writing is now before the said deed or instrument of writing was attested by him and the said William H. Jester to have been executed in Philadelphia by the said William and Mary Geddes as appears by the same. And whereas John Comegys, Esquire, hath at this day appeared before us, the subscribers, two of the Justices of the Peace for Kent County, and hath made oath on the holy Evangelist of Almighty God that he being well acquainted with the handwriting of the said William H. Jester now decedent, doth think and verify [he] believes the signatures of William H. Jester as a subscribing witness to the said deed from William Geddes and Mary Geddes to Benjamin Massey is in the handwriting of William H. Jester, now deceased, October 22, 1800.
