Peter Massey to Nicholas Massey, June 12, 1714

Peter Massey hands over, solely out of love and affection, a 100 acre parcel called Johnson's Adventure (adjacent to land laid out for Symon Willmore) to Nicholas Massey.  Witnesses: Nicholas Bonds, John Collins, and James Wilson, Senior; Francis Spry, and Bon Bonner.  Acting for the Crown: John Salter and John Whittington.
This indenture made the eighth day of March in the twelfth year of the reign of our sovereign Lady [illegible] of the [illegible] England, Scotland, France, and Ireland, Queen defender of the faith etc. Between Peter Massey of Kent County in the Province of Maryland, planter on the one part, and Nicholas Massey of Queen Anne's County, planter on the other part; Witnesseth that the said Peter Massey as well for his natural love and affection which to him he always [illegible] gave [illegible] as for other diverse good reasons and considerations to him here onto [illegible] moving to give, grant, bargain, sell, alien, enfeoff and confirm; and in and by these presents hath given, granted, bargained, sold, aliened, enfeoffed, and confirmed unto him, the said Nicholas Massey, his heirs and assigns, all that tract or parcel of land called Johnson's Adventure lying and being on the East side of a small branch running out of the Unicorn Branch on the south side of the [illegible] River in Queen Anne's County aforesaid. Beginning at a marked white oak, being the first bounded tree of a parcel of land formerly laid out for Symon Willmore and running from thence South with that land three hundred and twenty perches, then West one hundred perches and from thence with a straight line to the first tree containing one hundred acres of land more or less, [illegible] with all its rights, benefits, privileges, houses, gardens, orchards, with all other the appurtanences thereunto belonging to the only use and behoof of the said Nicholas Massey, his heirs and assigns, forever free and clear and freely and clearly released, exonerated, acquitted, and discharged of and from all former gifts, grants, [illegible], leases or forfeitures whatsoever, the rents and services which from henceforth shall grow due and payable to the [illegible] Lord or Lords of the fees accepted and foreprized, and further the said Peter Massey doth for himself and his heirs covenant, grant, and agree to and with the said Nicholas Massey, his heirs and assigns, [illegible] and with every of them by these presents that the before mentioned premises together with all and every of their appurtenances are free and clear from all encumbrances whatsoever, and further the said Peter Massey doth by these presents by himself, his heirs, executors, and administrators do save, defend, and keep harmless the said Nicholas Massey, his heirs and assigns, against all manner of persons whatsoever will forever warrant and defend and by these presents forever quit quitclaim freely and fully release all the right, title, interest, estate, [illegible] and demand whatsoever. I now have or of right might have by any ways or means whatsoever [illegible] hereby wholly release, invest in upon the said Nicholas Massey, his heirs and assigns, forever and to his and their own proper use and behoof forever and these lands Peter Massey for himself and for his heirs doth further covenant and agree to and with the said Nicholas Massey, his heirs and assigns, at the reasonable request of the [illegible] said Nicholas Massey, his heirs and assigns, to make, do, execute, and suffer or cause to be made, done, executed, and suffered all such further assurance or assurances, conveyance or conveyances requisite in the premises [illegible] the said Nicholas Massey, his heirs and assigns, or his or their counsel learned in the law, and shall reasonably advise, devise, or require. In witness hereof the parties above named in these presents indentures have interchangeably set their hands and seals the day and year above written.

Memorandum: On the back of the foregoing indenture was endorsed as following this.: Memorandum June 12th, 1714. Then came Peter Massey of by Nicholas Hand's attorney before us two of her Majesty's Justices of the Peace of Queen Anne's County whose hands are hereeunto affixed and acknowledged the within deed for the uses within mentioned according to a certain act of assembly in that behalf made and provided.

Maryland aforesaid. Know all men by these presents that I, Peter Massey of Kent County and the Province of Maryland, planter, have made, deputed, instituted, authorized, and appointed and in and by these presents do order and appoint in my trusty and well beloved [illegible] Nicholas Hands of Queen Anne's County in the province aforesaid set my true and lawful attorney for me and in my name to acknowledge a deed for a certain tract of land called Johnson Adventure lying in Queen Anne's County aforesaid containing one hundred acres in open court at a [illegible] to behold for Queen Anne's County aforesaid or before two of her Majesty's Justices of the Peace for the county aforesaid to the only proper use and behoof of Nicholas Massey of Queen Anne's County aforesaid and to his heirs and assigns forever according to the purport of the land deed ratifying, allowing, and holding firm and affixed by seal this fourth day of June Anno Domini 1714.

Memorandum: On the back of the foregoing letter of attorney was endorsed as following viz.: Memorandum, June 12th, 1714: Then came the within [illegible] and made oath on the Holy Evangelist that one of them saw the within named Peter Massey seal and deliver the within letter of attorney on the other and the other saw him signed sealed delivered the same as his act and deed for the use within mentioned before us two of her Majesty's Justices of the Peace for Queen Anne's County.
